I'm not sure that this does settle the doubt.

The difference between Have I Got News For You on Youtube and "JaM Radio" is that the BBC makes money from releasing JaM on CD whereas there's a very limited commercial market for HIGNFY. As soon as "JaM Radio" is seen as a threat to the BBC's commercial interests, however small, you'll know about it.

I'm not familiar with what happens in Espen's country with regard to "take down notices" but I'd suggest Espen reads up on it, just in case.

I wish you luck and I hope that your service is tolerated by the BBC as it's a great idea. Just be prepared for the alternative.
